The City of Garnavillo City Council met in a regular session on Wednesday, October 12, 2022 at 6:00 pm at the Community Center, 106 W Niagara Street, Garnavillo.

The meeting was called to order by Mayor Protem Roger Balk.

Roll call was taken, council members present were Mike Schmelzer, Roger Balk, Daryl Petsche and Bill Rademacher. Council Member Shelley Dietrich was absent.

Old Business

Storage Container Ordinance – First Reading

Council members discussed the language in the proposed ordinance and felt that it needs more work. They asked staff to research other community’s ordinances that better addresses containers in residential areas.

City/County Shared Shop 28E Agreement

New County Engineer Casey Stickfort and County Supervisor Sharon Keehner attended the meeting and discussed the proposed 28E agreement. Council, staff and guests determined it would be best if City Administrator Atkinson, Public Works Superintendent Schroyer and County Engineer Stickfort meet and discuss the agreement and bring it back to council at the November meeting.

New Business

Lavern Troester, Curb Stop Repair Dispute

Resident Lavern Troester addressed council regarding his bill for repairing the curb stop for his property, he would like the city to pay for half of the repairs. City Administrator Atkinson explained that the code states that the resident is responsible for the maintenance and repair which follows state code. Council members and Troester discussed his request.

Clayton Ridge Community School District Banners

Council members and staff discussed the request received to purchase and put up Clayton Ridge banners, they stated that they are interested but would like to research options and installation requirements.

Speed Sign Purchase

Council reviewed the sign proposals received and asked Attorney Kruse to send a letter to SA-SO Solar Traffic Products regarding the malfunctioning sign we have on the north end of town.

M/S Schmelzer/Rademacher To approve Resolution 2022-64 A resolution approving the purchase of a new speed sign from Elan City contingent on whether or not they can get the sign we have to stop flashing and work correctly.

Meier Addition Restrictive Covenant

City Administrator Atkinson presented the restrictive covenants to the council for review, asking if the council would be interested in changing the covenants to allow for previously lived-in homes to be part of the development. Council, Attorney Kruse and staff discussed the pros and cons of changing the covenants and determined that they were not in favor of this particular change but they would like to have a more in-depth discussion regarding the covenants as a whole. Attorney Kruse will prepare a memo after she reviews the current covenants.

Municipal Farm Ground

City Administrator Atkinson explained to council that Terry Frommelt had been contacted via certified letter in August, 2021 that he could no longer farm city ground but that he is still farming it. Council discussed the action they would like to take.

M/S Schmelzer/Petsche To approve Resolution 2022-65 A resolution regarding municipal farm ground, directing Attorney Kruse to prepare a lease for the 2022 harvest and send a letter explaining to Mr. Frommelt that he needs to sign the lease and pay $250.00 per acre (8 acres) to be able to harvest this year.

Engineer’s Report

Public Works Superintendent Schroyer provided council with Engineer Wicks update on the stormwater project repairs and the letter that Wicks is going to send to contractor, Ray’s Excavating.

Attorney Report

Attorney Kruse reported that she is still working on the Colsch/Scheppele properties. Department Reports

Public Works Superintendent Schroyer provided council with report. Council asked about the community center door and asked if the bid included installation. PWS Schroyer stated that it did and council stated that they do not feel that they should have to pay for any additional work or have a second contractor help. PWS Schroyer stated that spoke to Jeff Hoeger who said that the current door is still in really good shape that we just need to replace the bar. Schroyer also stated that we measured and believe the door will fit city hall.

City Administrator/Clerk Atkinson provided a written report to council in their packet, she highlighted that she is starting to work on the budget.

Chief of Police Hoyheim provided council a written report in the packet, she was unable to attend.

Council Comment

Council Member Schmelzer asked if staff was able to get an estimate on a new roof for the salt/sand shed. PWS Schroyer stated that since he was off he was unable to work on it. Schmelzer also asked if the dump truck was ready for the winter.

Council Member Balk asked about dirt bikes in town, he said there are quite a few. Mayor’s Report
