Elkport woman sentenced to 30-years in prison on charges of Homicide and Serious Injury by Motor Vehicle While Intoxicated

The sentencing hearing for Susan Steve of Elkport was held Tuesday, March 10. In January, Ms. Steve had been found guilty by a jury of the crimes of Homicide and Serious Injury by Motor Vehicle While Intoxicated for her role as driver of a vehicle that struck a UTV outside of Elkader on October 13, 2024. That accident claimed the life of Elkader resident Randy McMillin and seriously injured his wife, Mary Ann McMillin. The mandatory prison sentences are 25 years for the homicide and 5 years for the serious injury. At the sentencing hearing, Clayton County Attorney Zach Herrmann argued that those two sentences run consecutively to each other (or back-to-back), while Ms. Steve’s defense attorney asked that they run concurrently, or at the same time. After considering the arguments and hearing from the family of the McMillins, Judge Laura Parrish ordered the sentences to run consecutively. According to County Attorney Herrmann, the 30 year prison sentence does not carry any mandatory minimum, and that the Department of Corrections ultimately determines when Ms. Steve will be released.
